Terms of Service

These terms govern your use of TIKT. Please read them carefully: by creating an account or using TIKT, you accept them.

1. Who we are, and who these terms are for

TIKT is operated by Maxime Musset, entrepreneur individuel (EI), 21 boulevard Alex Auvinet, 85600 Montaigu-Vendée, France (“TIKT”, “we”, “us”). These terms form an agreement between us and the business on whose behalf you create an account (“you”, the “Customer”).

TIKT is a professional service. By accepting these terms, you confirm that you use TIKT for the purposes of your trade, business or profession, and that you are authorised to accept these terms on behalf of your business.

2. The service

TIKT monitors the LinkedIn profiles and posts you choose, identifies people who publicly react to or comment on those posts, assesses them against the ideal customer profile you define, and makes the results available in the application and as exports (the “Service”).

TIKT relies on publicly available information and on third-party providers. We do not guarantee that every person who engages with a post will be found, that the information collected is complete or up to date, or that any person will become a customer. Assessments are produced with automated tools, including AI models, and may contain errors: each one comes with its reasoning so that you can check it before acting on it.

We may improve, change or remove features of the Service. We will inform you in advance of any change that materially reduces what you have paid for.

3. Your account

You must provide accurate information, keep your sign-in methods secure, and tell us promptly at maxime@trytikt.com if you suspect unauthorised use of your account. You are responsible for the activity carried out through your account.

4. Credits and free trial

  • The Service is measured in credits. One credit is used for each eligible person processed, whether or not that person matches your ideal customer profile.
  • New accounts receive a free trial of 1,250 credits, valid for 7 days, with no credit card required. We may limit free trials to one per business.
  • Credits are valid only for the trial or billing period for which they are granted. They have no cash value and cannot be refunded, transferred or exchanged.
  • When your credits run out or your trial or billing period ends, processing stops until new credits are available.

5. Paid plans

Paid plans, their prices and the credits they include are described on our website. When you subscribe, you authorise us and our payment provider to charge the applicable fees, plus taxes, at the start of each billing period until you cancel. We may change our prices with at least 30 days' notice; the new price applies from your next billing period after that notice. Fees already paid are not refundable, except where the law requires otherwise.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent or harmful purpose, or to harass, spam or deceive anyone;
  • resell, publish or distribute the results of the Service as a dataset, or make them available to third parties other than your own service providers;
  • use the results to make decisions that produce legal or similarly significant effects on a person, such as decisions about employment, credit or insurance;
  • copy, reverse-engineer, scrape or overload the Service, circumvent its limits or security, or access it by automated means other than those we provide;
  • create several accounts to obtain additional free trials.

You are responsible for how you use the results, and in particular for making sure that any outreach you carry out complies with applicable law, including data protection and anti-spam rules, and with the terms of the platforms you use to contact people.

7. Data protection

7.1 Your account data

We process the personal data of your users and contacts as data controller, as described in our Privacy Policy.

7.2 Data processed on your behalf

When you use the Service, you decide which profiles and posts are monitored and which criteria apply. For the personal data processed through the Service at your instruction (“Prospect Data”), you are the data controller and TIKT is your processor. This section 7.2 forms the data processing agreement between us under Article 28 of the General Data Protection Regulation (GDPR). TIKT will:

  • process Prospect Data only to provide the Service and on your documented instructions, which are given by your configuration and use of the Service and by these terms, unless the law requires otherwise;
  • ensure that the people authorised to process Prospect Data are bound by confidentiality;
  • implement appropriate technical and organisational security measures;
  • use sub-processors to provide the Service, under written terms that offer the same level of protection; you give us a general authorisation to do so, we will inform you of any intended change to our sub-processors, and you may object by closing your account. The list of our sub-processors is available on request;
  • assist you, taking into account the nature of the processing, in responding to requests from individuals exercising their rights and in meeting your obligations regarding security, breach notification and impact assessments;
  • notify you without undue delay after becoming aware of a personal data breach affecting Prospect Data;
  • delete Prospect Data after the end of the Service, unless the law requires us to keep it;
  • make available the information reasonably needed to demonstrate compliance with these obligations.

As data controller, you are responsible for having a lawful basis to process Prospect Data, for informing the people concerned where required, and for respecting their rights, including their right to object to direct marketing.

8. Intellectual property

TIKT and all its software, content and branding remain our property. Subject to these terms, we grant you a non-exclusive, non-transferable right to use the Service and its results for your internal business purposes during your subscription or trial. You keep all rights to the information you provide. If you send us feedback, we may use it freely to improve the Service.

9. Third-party platforms

TIKT is independent of LinkedIn and is not affiliated with, endorsed or sponsored by LinkedIn. The Service depends on third-party providers and on the public availability of information, which may change without notice.

10. Availability and warranty

We work to keep the Service available and reliable, but it is provided “as is” and “as available”, without warranty of uninterrupted operation, of accuracy of the results or of fitness for a particular purpose, to the extent permitted by law.

11. Liability

To the extent permitted by law, we are not liable for indirect damages, such as loss of profit, revenue, business opportunity or data, and our total liability under these terms is limited to the amounts you paid us for the Service during the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law, including liability for gross negligence or wilful misconduct.

12. Suspension and termination

You can stop using TIKT at any time and ask us to close your account at maxime@trytikt.com. We may suspend or close an account that breaches these terms, that puts the Service, other customers or third parties at risk, or that remains unpaid, with notice where reasonable. When an account is closed, processing stops and data is deleted as described in our Privacy Policy and in section 7.

13. Changes to these terms

We may update these terms. We will change the date at the top of this page and inform you by email or in the application at least 15 days before a significant change takes effect. If you continue to use TIKT after that date, the new terms apply; if you do not accept them, you can close your account.

14. Governing law and disputes

These terms are governed by French law. Before any legal action, we will both try to resolve the dispute amicably. Failing that, the competent French courts will have jurisdiction.
